Simple.
Company hires me, does third party background check, doesn’t like what it finds, company tells me the results, states I can appeal, and fires me all in one meeting.

Here’s the thing. According to the Fair Credit Reporting Act, Section 604(b)(3), requires an employer, before taking "any adverse action based in whole or in part on [a consumer] report," to provide to the affected consumer/employee a copy of the report and a description in writing of the consumer’s rights under the FCRA; and (2) Section 615(a), which requires certain disclosures to be made after adverse action is taken by any report user.

Okay, so federal law is being violated…what can I do now? I’m not looking for a big payout, I just want my job back. BUT, if I cannot get my job back I might as well be paid for having my rights violated. I will lose out on AT LEAST two weeks of work because the law was not followed. This company is a national company with branches in nearly every state and from talking with their HR department I’ve learned that this is how things are done throughout the company. This appears to be a class action lawsuit in the making, right??

Any advice on my next course of action will be greatly appreciated.
Donald, background checks fall under the Fair Credit Reporting Act. It’s called a consumer report and an employee is a consumer in this context.

I told the whole truth on the application and there is nothing that showed up that I had not already admitted to. Still, I was hired till the report came back and then I was fired. This is the company’s standard practice. Fine, I’m not disputing the company’s right to fire me. What I am disputing is the fact that the law states they must provide me with a "Pre-Adverse Action Notice" letter when the background check came back and provide me with a reasonable amount of time to dispute its accuracy. Instead, as soon as the report came back I was simply fired and told to appeal it.

I was arrested when i was 19 for possession of cocaine. It was 1 gram. I went to court did my n.a, took my drug tests all for a year and i was told i would not get convicted if i did all that. Now in trying to get an apartment and this popped up. Causing me to get denied. But i had a background check done for work and i had no problem… if i was not convicted does it show as less of a felony? This happened 3 years ago
This happened in Florida. And i was not convicted. How can i remove this?

When I was young and dumb (10 years + ago), I was arrested a few times. Once for underage drinking at age 19, once for transporation of alcohol by a minor (I wasn’t drinking but there was beer in my car), and two times for driving on suspended after losing my license for the transportation charge. I was given court supervision for each offense and it has been over 10 years since I was arrested…I have grown up a lot since then.

I am becoming a CPA soon and will be applying for jobs, so I was trying to get a record of the dates of the arrests, etc. and I contacted the IL state police and got a fingerprint record and nothing showed on it. I called them and they said that if I was given supervision (which is not a conviction, she said), it will not show up. I also did a background check on myself and paid a good chunk of money and it turned up nothing….why??? Does anyone know why none of those offenses are showing up?

and I would like to know should I worry about the municipal charges that were not on the report and just concentrate on the state report?
